Terms and Conditions for Using "Desynat" Application Preamble and General Provisions: Welcome to the Desynat application, the leading electronic platform specialized in presenting and displaying the latest fashion and clothing by Kuwaiti designers. These Terms and Conditions constitute a legally binding agreement between the "Desynat" application (hereinafter referred to as the "Application" or the "Management") and any person who downloads the application, browses it, creates an account on it, or uses it to complete purchase transactions (hereinafter referred to as the "User" or the "Customer"). Your mere use of the application constitutes your explicit acknowledgment of reading, understanding, and fully agreeing to all the clauses contained below without restriction or condition. If you do not agree to these terms, please immediately stop using the application and uninstall it. Article 1: Definitions of Terms - The Application / Platform: The "Desynat" application available on smartphone stores, and all associated services and application programming interfaces (APIs). - The User / Customer: Any natural or legal person who benefits from the services of the application by browsing or purchasing. - Designers / Stores: Independent Kuwaiti female designers who own selling spaces (virtual stores) within the application to display their clothing pieces and designs. - Products: All clothing, fashion, and pieces offered for sale via the platform. Article 2: Account Conditions, Legal Capacity, and Security - Capacity: The user acknowledges that they have reached the legal age to use the application and conclude contracts (18 calendar years), or that they are using the application under the direct supervision of a parent or legal guardian. - Accuracy of Data: The customer undertakes to provide complete, accurate, and correct information upon registration (full triple name, active phone number, detailed delivery address, and email). The customer alone bears full responsibility for any error in shipping or delivery resulting from the inaccuracy of this data. - Account Security: The user bears absolute responsibility for maintaining the confidentiality of their login data and password. The user is considered responsible for all activities and financial transactions carried out through their account, and undertakes to notify the application management immediately upon suspecting any breach or unauthorized use. Article 3: Purchase Policy, Prices, and Payment Mechanism - Payment Methods: The application provides secure and approved electronic payment channels within the State of Kuwait, including the K-Net network and credit cards (Visa / MasterCard). - Currency and Fees: All prices are displayed in Kuwaiti Dinars (KD). These prices are inclusive of the product itself, while delivery and shipping fees are added independently and appear to the customer in the invoice summary before completing the final payment step. - Order Confirmation: A purchase order is not considered accepted and confirmed except after completing the payment process successfully and issuing a digital confirmation notice to the customer via the application or their registered email. Article 4: Shipping and Delivery Policy - Scope of Coverage: Products are shipped and delivered to all specified areas within the State of Kuwait (and in case of expansion, to international areas specified in the shipping options in the application). - Timeframes: The time taken to deliver the order varies based on the nature of the piece; ready-made pieces are shipped immediately, while pieces that require special tailoring (made-to-order preparation) take a longer period, which is explained approximately on the product page or during payment. - Delivery Contingencies: In the event that delivery of the shipment is not possible due to the customer's absence at the agreed time, or their lack of response to the delivery representative's calls, additional fees may be imposed to reschedule the delivery. Article 5: Cancellation, Exchange, and Return Policy Due to the special nature of the products displayed in the "Desynat" application, which combines ready-made pieces for immediate shipping and exclusive designs executed specifically based on order, the exchange, return, and cancellation policy has been determined according to the following regulations and in line with consumer protection legislation in the State of Kuwait: First: Order Cancellation The customer has the right to cancel the purchase order and recover its full financial value within a maximum period of (3) three hours only from the time of completing the purchase and payment process via the application. Once these three hours have elapsed, the order becomes effective and completely non-cancellable, due to the designer starting the procedures of preparing the piece, cutting the fabric, tailoring, or shipping. Second: Differentiation Between Product Types for Returns and Exchanges - Ready-to-Wear Pieces: The customer has the right to request an exchange or return for ready-made pieces (which have not been modified or tailored specifically for them) within the legally prescribed period according to consumer protection laws, provided that the piece is completely in its original condition, unused, carries all commercial tags, and is in its original packaging. The customer bears the fees related to return shipping and delivery in this case. - Made-to-Order and Special Tailoring Pieces (Tailor-made): Pieces that are manufactured, sewn, or modified based on the customer's request and special measurements are definitively non-returnable and non-exchangeable, due to the impossibility of reselling them, unless a major manufacturing defect or a clear error in execution by the designer is proven that is contrary to the requested specifications. Third: Reporting Manufacturing Defects and Errors In the event of receiving a product containing a manufacturing defect or an error contrary to the order (whether it is a ready-made piece or special tailoring), the customer must notify customer service via the available channels in the application, attaching illustrative photos and the invoice, within a maximum period of (24) twenty-four hours only from the time of receiving the shipment from the delivery company (according to the delivery time certified by the shipping representative). No complaint or claim of a defect or shortage will be considered or accepted after this period has elapsed. Article 6: Intellectual Property Rights - Content Ownership: All intellectual property rights, trademarks, logos, visual designs, software, images, texts, and databases of the "Desynat" application are the exclusive property of the application and the participating designers. - Prohibition and Protection: It is strictly prohibited to quote, copy, reproduce, distribute, or exploit any design or content displayed within the application for commercial or personal purposes outside the platform without obtaining prior and explicit written permission from the application management and the concerned designer. Any violation of these rights exposes its perpetrator to legal and judicial accountability. Article 7: General Conduct and Digital Restrictions The user undertakes to use the application for its intended and legitimate purposes only, and pledges not to do the following: - Attempting to breach the infrastructure of the application, using malicious software, or disrupting the platform's servers in any way. - Using automated data extraction tools (robots or spiders) to copy contents or prices collectively. - Publishing any comments, ratings, or texts that are offensive, obscene, or involve defamation of the designers or the application. Management retains the full right to delete these comments and block the offending account. Article 8: Limitation of Legal Liability - Nature of the Platform: The "Desynat" application acts as an advanced intermediary platform connecting Kuwaiti designers and customers. While we are fully committed to reviewing and selecting the finest designers and emphasizing quality, the direct responsibility for matching exact measurements, the quality of fabric materials, or the accuracy of execution lies with the designer (the owner of the virtual store) as the direct seller. - Service Continuity: The application management exerts its maximum efforts to ensure the operation of the platform around the clock, however, it does not guarantee the non-occurrence of temporary technical interruptions resulting from periodic maintenance work or software updates, and bears no responsibility for any damages resulting therefrom. Article 9: Amendment to the Terms and Conditions The management of the "Desynat" application reserves the absolute right to update, amend, or replace any part of these Terms and Conditions at any time it deems appropriate in line with the development of services or legal changes. These amendments are considered effective and applicable immediately upon their publication on this page within the application, and the user's continued use of the application after publication constitutes an implied agreement to the updated terms. Article 10: Applicable Law and Jurisdictional Competence This agreement, with all its clauses, shall be governed, interpreted, and applied in accordance with the laws and legislations in force in the State of Kuwait (including electronic transactions and consumer protection laws). In the event of any dispute or disagreement arising in connection with the use of the application or resulting from the interpretation of these terms, the adjudication thereof shall be within the exclusive and absolute competence of the Kuwaiti courts of all degrees.
